CRS APC guber candidate: Court restrains Owan, Upholds Usani

The power tussel  that has been on going Cross River State chapter of the All Progressive Congress, APC over the authentic Governorship candidate of the party has taken a new dimension as an Abuja High Court on Monday granted an order restraining the Independent National Electoral Commission, INEC from recognizing Sen. John Owan Enoh as the candidate of the party.

According to Justice Valentine B. Ashi who granted the order as requested by Dr. Usani Usani seeking to restrain INEC from recognizing the third defendant  Sen. John Owan Enoh as the First defedant's flag bearer. The order as granted directed the INEC to only recognize the claimant, Dr. Usani Uguru Usani, Honourable Minister of Niger Delta, as the authentic candidate.

It should be recalled that the Etim John's faction had conducted it's primary elections which produced the Honorable Minister of Niger Delta as its flag bearer while another faction of the party led by Mathew Achigbe purportedly held it's own primary where Sen Owan  Enoh was said to have emerged as its flag bearer.

While the national leadership of the party declared Owan Enoh as the authentic candidate, Usani in the other hand rejected the position and approached a court set aside the contentious Congress that produced Owan Enoh.

The court has now issued an interim order  favouring Usani pending the hearing and determination of the matter.

The case was adjourned to today, Wednesday 17 October for further hearing.

TDN could not get Sen Owan Enoh's reaction to the court order as he did not take his calls nor return same as at press time.

But in a telephone chat with a close associate of the senator who would not want to be disclosed, TDN learnt that Sen Owan is not perturbed with recent developments.

The source disclosed that APC Primary Elections has no business with state executive rather it is the national body of the party that sets up committees to conduct primaries, and Owan's Primary election was conducted by the authentic committee sent by the National Working Committee of the party as such anybody seeking to challenge his victory should challenge the authenticity of the committee that conducted the election as stipulated by the Party's constitution and not the authenticity of the state executive as his victory is not an Executive affairs but rather a NWC affairs.

Here is the Order as issued by the Court:
