CJN: C'River youth group calls for suspension of Justice Tanko

A Political pressure cum support group in Cross River State known as Cross River State Youths for Ayade and Atiku (CRYFAA) has called for the immediate  suspension of Justice Tanko Mohammed by the Nigeria Judicial Council (NJC) for presenting himself to be sworn in as acting Chief Judge of Nigeria by President Muhammadu Buhari, when he knows its unlawful to do so in the face of the circumstances surrounding his purported appointment. 

The group in a Press statement issued and made available to TDN quoted Prof. Agu Gab, a renowned professor of law who argued that the same justice Tanko was among the NCJ that suspended Justice Obisike Orji of Abia State for presenting himself to be sworn in, after reversing the suspension of Justice Theresa Uzokwe who was initially suspended by governor Okezie Ikpeazu.




The statement reads in part: 

"...That the judiciary should seek for a Court declaration against Justice Tanko Mohammed from performing in the office of CJN in whatever capacity.
That Justice Tanko Mohammed be suspended by the NJC".


"Remember that Justice  Theresa Uzokwe of Abia State Judiciary was suspended as Chief Judge and Justice Obisike Orji was sworn in to act in her place, by Governor Okezie Ikpeazu, PhD. The NJC with Justice Tanko Mohammed in attendance reversed the action as unconstitutional and suspended Justice Obisike Orji for presenting himself to be sworn in. 

We are of the opinion that the NJC should act now to save the Judiciary from executive coup. Justice Tanko Mohammed has eaten his vomit by accepting what he joined to condemn in Abia State". 


The group used the opportunity to call on Nigerians to vote out any government who is tyrannical in nature and vote in Atiku Abubaka as the man who will cater for the teeming needs of Nigerians as he will make welfare of Nigerians his priority. 



The Press statement reads in full: 


PRESS RELEASE ISSUED BY CROSS RIVER STATE YOUTH FOR AYADE AND ATIKU (CRYFAA) ON THE UNJUSTLY REMOVAL OF THE CJN 




It is very disheartening and disturbing to note that at this stage of our nascent democracy which many heros past and present and patriotic Nigerians alike have fought and many given their lives to see a Nigeria that we all cherish is being threatened by some elements who by chance found themselves into power.   


The purported suspension of the Chief Justice of Nigeria (CJN), Honourable Justice Walter Onnoghen, by President Muhammadu Buhari is unequivocally unconstitutional, illegal, immoral and grossly indefensible. What General Buhari has done, putting it mildly, is a brazen coup against democracy.



It is on this note that, we members of Cross River Youth for Ayade and  Atiku totally and in all ramifications reject the illegal suspension of CJN Walter Onoghen by President Buhari on the spurious advice of the CCT which is working in tandem with APC-led government to enthrone dictatorship in the country. The action of federal government is a coup against the judiciary. We, therefore demand for his immediate re-instatement of the CNJ.


We want to also use this medium to call on all Nigerians, Christians and Muslims, Northerners and Southerners to collectively fight against this act which is not only unconstitutional, but alien to our democracy, we must resist dictatorship in all its form and rescue our nation from the hands of tyrants and a deadly secret cabal that has hijacked our nation Nigeria and heading for destruction. 



We will like to key into the opinion of Professor Agu Gab Agu, a Professor of Law who while wading into the matter of Onnoghen's illegal suspension opined as follows:

1. That the judiciary should seek for a Court declaration against Justice Tanko Mohammed from performing in the office of CJN in whatever capacity.

2.That Justice Tanko Mohammed be suspended by the NJC.

3. That Justice Umar of the CCT be suspended by NJC and tried by Legal Practitioners Privileges Committee 

4. That a competent Court should be approached and an order be issue reversing the executive act of the President in suspending Justice Onnoghen as the CJN.  

Now, Remember that Justice  Theresa Uzokwe of Abia State Judiciary was suspended as Chief Judge and Justice Obisike Orji was sworn in to act in her place, by Governor Okezie Ikpeazu, PhD. The NJC with Justice Tanko Mohammed in attendance reversed the action as unconstitutional and suspended Justice Obisike Orji for presenting himself to be sworn in.

If there's anytime Nigerians needed to speak with unity and togetherness, this is the time. We must speak and let our voice be heard and this time, we must speak through the ballot, we must vote out anyone who is a threat to our Democracy and our common interest as Nigerians. 

For us at CRYFAA, we will ensure we mobilise support from all nooks and crannies to not just ensure the unjustly removal of the CJN in person of Justice Walter Onnoghen is reversed but also to see to it that a new government that will respect separation of powers, rule of law and democracy as well as make the welfare of Nigerians a top priority is enthroned come 29th May, 2019.
