RE: REQUEST FOR CROSS RIVER STATE HOUSE OF ASSEMBLY RESOLUTION FOR APPROVAL TO ISSUE AN IRREVOCABLE STANDING PAYMENT ORDER (ISPO) OF N300,000,000.00 (THREE HUNDRED MILLION NAIRA) MONTHLY IN FAVOUR OF MESSRS SYDNEY CONSTRUCTION NIGERIA LIMITED IN RESPECT OF THE CONSTRUCTION OF THE 275KM – 6 LANE CALABAR IKOM KATSINA ALA SUPER HIGHWAY





1. PREAMBLE
Reference is hereby made to the letter of the above title dated 19/02/2019, 
addressed to the Rt. Hon. Speaker of the Cross River State House of 
Assembly. The said letter is bearing the letterhead of the office of the 
Secretary to the State Government of Cross River State and is purported to 
have been written and signed by your good self. 



2. OUR OBSERVATION
Our observation is that the said letter contains a number of issues that 
require clarifications from your office.


2.1) Foremost amongst these matters is the process by which the budget for the superhighway project was established. Our expectations are that from the very beginning, the budget for a project of such great magnitude ought to have been approved by the Cross River State House of Assembly (CRSHA). Your 
letter however, suggested that the cost of the project is established at N648, 870, 730,739.23 (Six Hundred and Forty 
Eight Billion, Eight Hundred and Seventy Million, Seven Hundred and Thirty Thousand, Seven Hundred and Thirty-Nine Naira, Twenty-Three Kobo. 


Correspondingly, we hereby request from your office the documents pertaining to the approval issued by the Cross River State House of Assembly (CRSHA) for the sum of money stated in your letter.


2.2) The letter refers that MERRS SYDNEY Construction Company is the contractor for the superhighway project. 
Correspondingly, we need clarification on the conformity of the appointment to the established due process of Cross River State government on procurement in matters relating to a contract of such great magnitude. 


2.3) It is our observation that the budget for the superhighway project stated in your letter under reference was never reflected in the following instruments of the CRSHA:
a) Supplementary budget for 2015;
b) Budget for 2016;
c) Budget for 2017;
d) Budget for 2018;
e) Budget for 2019.
Correspondingly, we wish to request from your office the basis for requesting expenditure of the sum of N648, 870, 730,739.23 (Six Hundred and Forty Eight Billion, Eight Hundred and Seventy Million, Seven Hundred and Thirty Thousand, Seven Hundred and Thirty-Nine Naira, Twenty-Three Kobo, on the superhighway project, despite the fact that there are no budgetary approvals to back up your request. 



2.4) We wish to express our observation from your letter under reference which shows that the approval that is being sort from the CRSHA pertains to a debt that is expected to be paid by us (Cross Riverians), our children, grandchildren, great grandchildren and up to the 6th (Sixth) generation (by the computation of 1(one) generation being approximately 30 years. To appreciate the enormity of this debt burden, scheduled to span a hundred and eighty (180) years, we have 
to recognize the fact that the newborn Cross Riverian of April 2019 will not live to see the birth of the generation that will pay up the last installment of the debt. It is indeed as serious as that. 


Correspondingly therefore, we request from your office the moral for committing 6 (six) generations of Cross Riverians to the debt burden of a single road project.




 
3. OUR REQUEST
With respect to our observation stated in paragraph 2 above, we hereby request from your office the under-listed documents.


(A) The extracts from the proceedings of the Cross River State Executive 
Council meeting pertaining to approval of a debt burden of N648, 870, 730,739.23 (Six Hundred and Forty Eight Billion, Eight Hundred and Seventy Million, Seven Hundred and Thirty Thousand, Seven Hundred and Thirty-Nine Naira, Twenty-Three Kobo, to be defrayed by Cross Riverians in 6 generations. 



(B) The extract of the proceedings pertaining to the appointment, by that 
established due process of the Cross River State in respect of the procurement and subsequent appointment of MERRS SYDNEY Construction Company as contractor for a road project of the magnitude of the stated contract sum of N648, 870, 730,739.23 (Six Hundred and Forty Eight Billion, Eight Hundred and Seventy Million, Seven Hundred and 
Thirty Thousand, Seven Hundred and Thirty-Nine Naira, Twenty-Three 
Kobo. 



(C) The certified true copies (CTC) of all documents of the Cross River State House of Assembly (CRSHA) pertaining to approvals issued in respect of the Superhighway project in the first instance and the budgetary allocations pertaining to the project. 



(D) The certified true copy (CTC) of the advertisement inviting interested 
persons (in the official gazette of Cross River State and/or selected Newspapers and/or News Magazines as required by due process) to tender for the superhighway project valued at N648, 870, 730,739.23 (Six Hundred and Forty Eight Billion, Eight Hundred and Seventy Million, Seven Hundred and Thirty Thousand, Seven Hundred and Thirty-Nine Naira, Twenty-Three Kobo.




Finally, Please kindly TAKE NOTICE, that all the above request have been made 
pursuant to the relevant provisions of the Freedom of Information Act 2011, the 
Constitution of the Federal Republic of Nigeria 1999 as amended; and other extant laws of the Federal Republic of Nigeria.
