Breaking: Appeal Court confirms late Mathew Achigbe authentic Chairman of APC C'River







A three man panel seated in Abuja has finally laid to rest the internal leadership tussle within the All Progressives Congress, APC in Cross River State. 


This came on he hills of a judgment delivered today in favor the late Mathew Achigbe's led EXCO now headed by Sir, John Ochala. The panel in its ruling confirmed Achigbe's led EXCO as the legitimate state EXCO of the party in Cross River. 


A statement circulated by one of the media aide to the party's factional candidate in the recently concluded Gubernatorial elections Sen. John Owan Enoh reads below; 

RE: JUDGEMENT IN APPEAL NO.: CA/A/19/19 – APC V. MR. SYLVESTER OKPO & 2 ORS

The Respondents in the above mentioned appeal had in 2018, approached the High Court of the Federal Capital Territory, Abuja, Bwari Division in SUIT NO.: FCT/HC/BW/106/2018 SYLVESTER OKPO & 2 ORS V. APC, seeking for recognition as the duly elected Cross River State Chapter, Executives and Delegates of the APC, emerging from congresses conducted by Chief Etim John on the 11th, 12th, 15th, 16th and 19th of May, 2018. On the 13th of December, 2018, the High Court of the Federal Capital Territory, Abuja, per Musa J, granted their reliefs and further directed the APC to recognize and field candidates who emerged from primaries conducted by Chief Etim John for the 2019 general elections. 

Being dissatisfied with the judgement of the High Court of the Federal Capital Territory, Abuja, APC, approached the Abuja Division of the Court of Appeal in APPEAL NO.: CA/A/19/19 – APC V. MR. SYLVESTER OKPO & 2 ORS. The appeal was argued on the 23rd of March, 2020 and Judgement delivered today the 23rd of April, 2020. In allowing the appeal and agreeing with the APC, the Court of Appeal set aside the judgment of the High Court of the Federal Capital Territory, Abuja and held that it had no jurisdiction to entertain the suit filed by the Respondents, as the subject matter of the suit was an intra-party affair and therefore not justiciable. The Court of Appeal also held that the High Court of the Federal Capital Territory, Abuja lacked territorial jurisdiction to entertain the suit being that it was in respect of intra party election into executive office of the Cross River State Chapter of the APC. The Court of Appeal further awarded cost of N 400, 000 (Four Hundred Thousand Naira) only, against the Respondents to be paid to the APC (Appellant).


Note that the internal crisis witnessed by the party in the last election had cost the party several electoral offices especially the governorship stool of Cross River State. 

In the light of this judgement, except the losing faction deems it necessary to take the matter to the apex court,  the APC in Cross River may just be on its way to uniting itself while it builds a formidable team against 2023 general elections.
